Template notice. These terms are a working draft prepared for the iCare Now platform. They must be reviewed by qualified counsel in each jurisdiction where the service is offered before launch, and are not themselves legal advice.
1. Who we are
iCare Now ("iCare Now", "we", "us") operates the Intervention Care platform: a library of intervention topics, a podcast, wellness tracking tools, group events and access to independent coaches, delivered through our website and mobile applications (together, the "Service").
2. What the Service is — and what it is not
The Service is a wellbeing, education and coaching platform.
The Service is not healthcare. It does not provide medical advice, diagnosis or treatment. It is not psychotherapy, counselling or psychiatric care, and no coach, contributor or podcast guest is acting as your clinician. Nothing in the Service creates a doctor–patient, therapist–client or other professional healthcare relationship.
The Service is not an emergency service. If you or someone else may be in danger, contact your local emergency number or one of the crisis lines listed at /crisis. We do not monitor content in real time and cannot respond to emergencies.
If you are receiving clinical care, the Service is intended to sit alongside it, not to replace it. Talk to your clinician before changing any treatment.
3. Eligibility and accounts
- You must be 16 or older to create your own account.
- Members aged 13 to 15 may use the Service only through a Care Circle where a parent or legal guardian has given verifiable consent, as described in the Guardian Consent Terms.
- The Service is not offered to anyone under 13.
- You are responsible for the accuracy of your account information and for keeping your credentials secure.
Where your access is paid for by an employer or an educational institution (a "Sponsor"), Section 9 also applies.
4. Your content
You keep ownership of everything you write, record or upload — check-ins, journal entries, S.E.W. sentences, community posts, episode feedback and topic requests ("Your Content").
You grant us a licence to host, store, back up, transmit and display Your Content solely to operate the Service for you and anyone you have explicitly shared it with. That licence ends when you delete the content or your account, subject to the retention periods in the Privacy Policy.
You must not upload content that is unlawful, that infringes another person's rights, or that breaches the Community Guidelines.
5. Community and shared spaces
Community feeds, event chats and podcast comment threads are shared with other members. Do not post anything there you would not want a stranger to read. Content that breaches the Community Guidelines may be removed and accounts may be suspended.
6. Care Circles
A Care Circle lets you share a defined slice of your wellness data with people you choose. Sharing is opt-in, scoped and revocable, and is governed by the Care Circle Sharing Terms. We never enable sharing on your behalf.
7. Coaching and events
Coaches are independent professionals, not our employees, unless we tell you otherwise in writing. We verify credentials at onboarding but we do not supervise the clinical content of any session. Coaching engagements are governed by the Coaching Services Agreement, which you accept before your first session.
8. Subscriptions and payment
- Paid plans renew automatically at the interval shown at checkout until you cancel.
- You may cancel at any time; access continues to the end of the paid period.
- Trials convert to a paid subscription unless cancelled before the trial ends.
- Statutory cancellation and refund rights in your jurisdiction are unaffected by anything in this section.
- Prices exclude tax unless stated.
9. Sponsored access
If a Sponsor pays for your seat:
- Your seat lasts as long as the Sponsor's agreement and your eligibility do. We will tell you before access ends and give you the option to continue on an individual plan.
- Your Sponsor never sees your individual data. They receive aggregate, de-identified reporting only, and only where the reporting cohort is large enough that individuals cannot be re-identified.
- A Sponsor cannot require you to share your data with them as a condition of a benefit, and cannot ask us for it.
10. Acceptable use
You must not: reverse engineer or scrape the Service; resell or share access; attempt to identify other members from aggregate data; use the Service to harass, impersonate or endanger anyone; or upload malicious code.
11. Intellectual property
The Service, including the intervention library, podcast recordings, and the software, is owned by us or our licensors. You get a personal, non-transferable, non-exclusive licence to use it while your account is active. You may not republish library or podcast content commercially without our written consent.
12. Suspension and termination
You may close your account at any time from Settings. We may suspend or terminate access where you materially breach these terms, where required by law, or where continued access presents a safety risk. Where practical we will tell you first and give you a chance to fix the problem.
13. Disclaimers and liability
The Service is provided "as is". To the maximum extent permitted by law we exclude implied warranties of merchantability and fitness for a particular purpose.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our aggregate liability arising out of the Service is limited to the greater of the amounts you paid us in the twelve months before the claim and USD 100.
14. Changes to these terms
We will give at least 30 days' notice in the app and by email before a material change takes effect, and will ask you to accept the new version. If you do not accept, you may close your account and we will refund any unused prepaid period.
15. Governing law and disputes
These terms are governed by the laws of the jurisdiction stated in your order confirmation. We will always try to resolve a complaint informally first — write to us at the address below.
